These Terms of Service ("Terms") govern your access to and use of the Vocari AI voice receptionist platform, website, and related services (the "Service"). By creating an account, clicking "I agree," or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Vocari provides software that answers your business calls, text messages, and chats using an automated artificial-intelligence assistant, and that can schedule appointments, quote prices, and relay messages on your behalf. Vocari is a software tool. It is not a law firm, medical provider, accountant, employee, or human answering service, and it does not provide professional advice of any kind.
You are solely responsible for how you configure and use the Service, including the scripts, prices, and information Vocari communicates. You agree not to use the Service to:
You are the sender and controller of communications with your customers. When Vocari calls or texts your customers on your behalf, you are responsible for having any legally required prior consent (including under the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and state law) and for honoring opt-out requests (STOP).
Call recording. The Service can record and transcribe calls. Florida and several other states require the consent of all parties to record a call. You are responsible for ensuring appropriate recording disclosures are used. By default, Vocari includes a spoken notice that the call may be recorded; you must not disable required notices.
You represent that you have all consents, permissions, and rights necessary for the numbers, contacts, and data you provide to us.
The Service uses automated AI that can make mistakes, misunderstand callers, or produce inaccurate or incomplete responses. You are responsible for reviewing appointments and information, and for supervising the Service. Vocari does not guarantee that every call will be answered, that any booking is correct, or that the Service will be uninterrupted or error-free. Do not rely on the Service for emergencies; it is not an emergency, medical, or 911 service.
The Service integrates with third parties (e.g., telephony and voice providers such as Twilio and Vapi, calendar and scheduling tools, and payment processors). Your use of those services is subject to their terms, and we are not responsible for third-party services.
We own the Service and all related intellectual property. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription. You retain ownership of your business content and customer data ("Your Data"); you grant us a license to process Your Data to provide and improve the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOCARI AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will indemnify and hold harmless Vocari and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Data, or your violation of these Terms or applicable law, including communications-consent and recording laws.
We may suspend or terminate the Service for violation of these Terms or non-payment. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. The exclusive venue for any dispute is the state or federal courts located in Florida, and you consent to their jurisdiction. Any dispute shall first be attempted to be resolved informally by contacting us.
We may update these Terms. Material changes will be posted here with a new effective date; continued use after changes means you accept them.
